By accessing or using WhaDAKAYO ("the Service"), operated by Gabriel Cassady and 2oddballs Creative LLC ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.
WhaDAKAYO is an AI Business Visibility Monitoring platform that queries multiple artificial intelligence models (including ChatGPT, Claude, Gemini, and Perplexity) to provide insights about how these AI systems perceive and represent your business. The Service provides analysis, sentiment tracking, and reporting based on AI-generated responses.
You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials. You agree to provide accurate, current, and complete information during registration. You are responsible for all activities that occur under your account.
WhaDAKAYO offers free and paid subscription tiers. Paid subscriptions are billed according to the plan selected (monthly, quarterly, or annually). Payments are processed securely through Stripe. You may cancel your subscription at any time through your account settings. Refunds are handled on a case-by-case basis.
You agree not to use the Service to: violate any applicable laws or regulations; infringe upon the rights of others; attempt to gain unauthorized access to the Service or its systems; use automated tools to scrape or harvest data; interfere with the proper functioning of the Service; or use the Service for any purpose that is harmful, fraudulent, or deceptive.
The results provided by WhaDAKAYO are generated by third-party AI models and are provided for informational purposes only. We do not guarantee the accuracy, completeness, or reliability of any AI-generated content. The sentiment analysis and mention counts are algorithmic approximations. You should not rely solely on WhaDAKAYO results for business decisions without independent verification.
The Service, including its design, features, and content (excluding AI-generated results), is the intellectual property of Gabriel Cassady and 2oddballs Creative LLC. You retain ownership of any data you provide to the Service. By using the Service, you grant us a limited license to process your data as necessary to provide the Service.
To the fullest extent permitted by law, WhaDAKAYO and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the twelve months preceding the claim.
We reserve the right to suspend or terminate your account at any time for violations of these Terms. You may terminate your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately.
We may update these Terms from time to time. We will notify users of significant changes via email or by posting a notice on the Service. Continued use of the Service after changes constitutes acceptance of the updated Terms.
These Terms shall be governed by the laws of the State of Missouri, United States. Any disputes arising from these Terms shall be resolved in the courts of Greene County, Missouri.
